Plaintiffs Olivia and Lisa Chernaik and Kelsey and Cathy Juliana brought suit to uphold their rights, as beneficiaries under the public trust doctrine to the use of Oregon’s public resources. Those inalienable rights are threatened with irreversible harm as a result of climate change and ocean acidification, due to dangerous levels of greenhouse gas emissions, and the predicted adverse impacts on Oregon’s natural resources. Plaintiffs seek a declaration that certain natural resources, including waters of the state, wildlife, and the atmosphere, are public trust resources. Plaintiffs also seek a declaration that Governor Brown and the State of Oregon as trustees have failed to uphold the fiduciary obligations under the trust by failing to take action to achieve necessary reductions in emissions of greenhouse gasses within the State in order to prevent, and remedy the existing, substantial impairment of public trust resources.
